This Privacy Policy explains how Porticus Marketplace Inc., doing business as LEND-IT.CA™ (“LEND-IT.CA™”, “we”, “us”, or “our”), collects, uses, discloses, retains, and protects Personal Information when you use our website, mobile applications, marketplace platform, communication channels, and related services.

LEND-IT.CA™ operates a Canadian rental marketplace that connects individuals and businesses who want to list, rent, borrow, or manage rental transactions through the platform. Users who rent items are referred to as “Borrowers”. Users who list items for rent are referred to as “Lenders”. Borrowers and Lenders are collectively referred to as “Users”.

This Privacy Policy is intended to address our obligations under applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act, and applicable provincial private-sector privacy laws where they apply.

“Personal Information” means information about an identifiable individual, including information that can identify an individual directly or when combined with other information.

2. Information We Collect

Depending on how you use LEND-IT.CA™, we may collect the following categories of Personal Information.

Account and profile information

This may include your name, email address, phone number, username, password or account credentials, profile photo, notification preferences, business name, business profile information, storefront details, service area, social media links, and other information you add to your account or profile.

Contact and location information

This may include your billing address, pickup address, delivery address, business address, general location, and, if you enable device permissions, precise location information.

You can disable location access through your browser or device settings. If you disable location access, you may still use the Services, but certain features may be less accurate or may require you to manually enter your address or location.

Unless expressly disclosed to you and enabled through your device settings, we do not collect precise location information when the app is not in use.

Listing, rental, and transaction information

This may include item listings, item descriptions, photos, pricing, availability, rental requests, booking dates, order history, transaction amounts, taxes, pickup and delivery details, instructions, return requirements, wish list activity, reviews, ratings, and information related to disputes, claims, damage, loss, theft, non-return, or customer support matters.

Communications

This may include in-app messages between Users, communications with LEND-IT.CA™, customer support requests, emails, SMS or text messages, phone calls, chats, feedback, survey responses, and related records such as the date, time, method, and outcome of the communication.

Payment and payout information

This may include information about payment methods, transaction status, deposit authorizations, refunds, fees, taxes, payout details, and related payment records.

Payment information is primarily processed and stored by our third-party payment processors.

Device, usage, analytics, and measurement information

This may include IP address, device type, browser type, operating system, app version, referring URLs, pages viewed, links clicked, search activity, session activity, approximate location derived from IP address, cookie identifiers, mobile identifiers, device or technology identifiers, log data, campaign attribution data, and information about how you interact with our website, mobile applications, emails, communications, and other digital services.

We may collect this information through cookies, pixels, tags, software development kits, APIs, analytics tools, measurement tools, attribution tools, performance tools, and similar technologies.

Fraud prevention, verification, safety, and security information

This may include information used to verify accounts, detect suspicious activity, prevent fraud or misuse, protect the platform, enforce our Terms of Service, investigate security incidents, and support safe rental transactions.

We may use Personal Information to create and manage accounts, display listings, facilitate rental requests, process bookings, process payments and payouts, manage deposits, support pickup and delivery, enable in-app messaging, display reviews, and provide the core features of the marketplace.

To improve the Services

We may use Personal Information to understand how Users interact with the platform, improve website and app performance, develop new features, troubleshoot issues, analyze trends, and make the Services more useful and reliable.

To support customer service

We may use Personal Information to respond to inquiries, investigate issues, resolve disputes, process support requests, handle claims, and communicate with Users about their accounts, transactions, listings, bookings, or use of the Services.

To protect trust, safety, and platform integrity

We may use Personal Information to verify accounts, detect and prevent fraud, investigate misuse, enforce our Terms of Service and policies, protect Users and the platform, respond to security incidents, and maintain a safe marketplace.

To process payments, taxes, and business records

These tools may collect or receive information such as IP address, device information, browser information, app activity, website activity, referring URLs, pages viewed, links clicked, search activity, cookie identifiers, mobile identifiers, log data, and campaign attribution information.

Pixels, web beacons, and similar technologies may be used in our website, mobile applications, emails, or other communications to understand whether a specific action occurred, such as viewing a page, opening an email, clicking a link, signing up, or completing another action.

To other Users

LEND-IT.CA™ is a marketplace that allows Users to create listings, communicate with one another, and arrange rental transactions through the Services. As a result, certain information you choose to provide or make available through the Services may be visible to other Users, such as profile information, storefront information, item listings, item descriptions, photos, availability, reviews, ratings, messages you send, and other content you choose to post, upload, or share.

Where reasonably necessary to arrange, complete, support, or resolve a rental transaction, we may also make certain transaction-related information available to the relevant Borrower or Lender, such as pickup or delivery details, booking details, return instructions, transaction status, and information needed to address support, safety, dispute, damage, loss, theft, or non-return matters.

We do not disclose Personal Information to other Users unless it is provided or made available by you through the Services, is necessary to facilitate or support a transaction or platform function, or is otherwise permitted or required by law.

Users may not use another User’s Personal Information for any purpose other than communicating about, completing, supporting, or resolving a rental transaction through the Services.

To service providers

We may disclose Personal Information to service providers and vendors that help us operate our business and provide the Services, including providers of cloud hosting, data storage, payment processing, payout processing, fraud prevention, security, analytics, measurement, marketing tools, email, SMS/text messaging, customer support, location and mapping, market research, auditing, accounting, legal services, and other business operations.

We do not authorize our service providers to use Personal Information for purposes unrelated to providing services to us, except where permitted by law or with your consent.

To technology, analytics, and measurement providers

We may use third-party technology, analytics, and measurement providers to help us understand the performance of our Services, communications, campaigns, website activity, app activity, and platform engagement.

Please note that even if you unsubscribe from marketing communications, we may still send you service-related communications.

14. Children and Minors

Our Services are not intended for individuals under the age of majority in their province or territory of residence.

For clarity, individuals under 18 are not permitted to use our Services. In provinces or territories where the age of majority is higher than 18, Users must meet the applicable age of majority requirement.

We do not knowingly collect Personal Information from individuals who are not permitted to use the Services. If a parent or legal guardian believes that we have collected Personal Information from someone who is not permitted to use the Services, please contact us.

15. Third-Party Websites and Services

Our Services may contain links to third-party websites, applications, platforms, or services that we do not control.
